APPLICABILITY OF THE TERMS AND CONDITIONS:

Any person (“The Customer”) who intends to avail or avail of VISA services of the Company shall be subject to the terms and conditions as detailed below.

By instructing the Company to undertake services on your behalf, the Customer is deemed to have accepted these terms and conditions. These Terms are to be read in conjunction with the E-Visa Xperts User Agreement and Privacy Policy.

SCOPE OF SERVICES AND PROCEDURE:

At the outset, the Customer agrees that they understand that the approval/rejection of visa, is at the sole discretion of the concerned Embassy/High Commission. E-Visa Xperts has no role in either assessing or processing the visa application. The scope of services offered by E-Visa Xperts w.r.t visa services is detailed hereinbelow.

E-Visa Xperts will provide the Customer with the information necessary for the visa application process (as provided by the respective Embassy/High Commission) along with the average time taken for the processing of a visa application, to enable a customer to apply for the visa promptly. Such information shall be provided on ‘Best Effort’, based on’E-Visa Xperts’ experience in providing such services. Information and visa requirements are subject to change and E-Visa Xperts does not warrant that information provided by it will always be accurate or complete.

All requirements for making a visa application (including, but not limited to, documentation, fees, and time frames) are calculated based on general criteria and can vary due to a lot of factors including but not limited to the information provided by the Customer (including, but not limited to, current or previous nationality, residence, gender, age, profession, recent travel, and religion). E-Visa Xperts shall not be liable for any additional/different requirements that may be raised by the concerned Embassy/High Commission.

Each country has varying requirements for passports and VISAs. For eg. Certain nations require a minimum number of blank pages in succession or period of validity. These requirements are established by sovereign nations and are subject to change without notice. While E-Visa Xperts always tries and ensure, its Customers are given, correct and updated information, there may be instances where the requisite is not made available to E-Visa Xperts, as a result of which E-Visa Xperts may not be able to provide the same to its customers. In such cases, E-Visa Xperts will not be held responsible for any inaccuracy in such information.

These requirements are established by sovereign nations and are subject to change without notice. While E-Visa Xperts tries to ensure that the information it provides is complete and correct, however, E-Visa Xperts cannot provide any guarantee or warranty in this regard. E-Visa Xperts will not be responsible for any inaccuracy in such information.

The services offered by E-Visa Xperts should not be considered or construed as visa advisory services in any manner whatsoever. E-Visa Xperts shall only provide a checklist of documents to its customers as prescribed by the concerned nation/country to apply for a visa and/or as per the best available information. For submission of documents, E-Visa Xperts may only cross-check the presence of documents as per the checklist without reviewing the contents of each document. E-Visa Xperts will also not advise on the merit of the documents and the likelihood of approval or rejection of the visa being applied for.

E-Visa Xperts may provide the services mentioned here or through third parties. E-Visa Xperts may also appoint third-party vendors for the visa application process for different countries. Such third-party vendors will be responsible for applying for the visas of customers for the respective countries they have been appointed for.

The customer undertakes to provide the documents required (as mentioned in the checklist) for the processing of the visa, promptly to E-Visa Xperts. The customer further undertakes that the documents submitted are genuine and further the information provided by the customer is true and correct. E-Visa Xperts shall bear no responsibility to verify the genuineness of the documents or the information provided. E-Visa Xperts in no manner checks the credentials of the documents given by the customer and only cross-checks the same with the checklist provided to the customer. Customers are also required to provide it with all necessary and correct information, to allow E-Visa Xperts to apply for visa processing, such information may include but is not limited to, the Customer name, address, holiday destination, and any other information that considers necessary for processing the Customer’s visa application. Once Necessary Information is supplied by a Customer to E-Visa Xperts, he/she agrees for E-Visa Xperts to file the necessary VISA application along with Visa Fees/Embassy charges on its behalf to the concerned consulate/embassy. The customer also understands that once a visa application is filed on their behalf, the concerned consulate/embassy/high commission may call the Customer for a face-to-face interview at its sole discretion. E-Visa Xperts shall have no role in this process and shall, where applicable, inform the Customer about the date, time, and requirements (if any) as communicated by the concerned Embassy/High Commission.

For UAE Visa: OK TO BOARD may be required. The customer understands that it is the complete discretion of the concerned Airline/ department to grant or reject ’ok to board”. Customers are required to provide valid communication details (mobile number/ email ID) at the time of applying for the Visa / OK TO BOARD services, as these will be the only point of contact for timely updates on the status of Customer Visa / OK TO BOARD application by E-Visa Xperts. Customers are requested to provide air tickets within 12 hours of the receipt of the e-mail regarding the OK TO BOARD requirement.

Certain areas of this Website are restricted from being accessed by you and E-Visa Xperts may further restrict access by you to any areas of this Website, at any time, at absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality as well.

SERVICE FEE

The Customer agrees to pay E-Visa Xperts a Service Fee towards the cost of providing the services of applying on the Customer’s behalf to the concerned Embassy. The Service Fee will be paid in addition to the Visa fees, Embassy charges, and other similar fees by applicable nomenclature or as prescribed by the respective visa department of a State. The customer is liable to pay the Service Fee at the time confirmation is given by him/her to avail services of E-Visa Xperts.
Any additional charges, including for logistics, i.e. pick up of documents, collection of passport, etc. or any courier charges shall be in addition to the service fees mentioned above.
Visa Fees, Embassy charges/taxes/and other miscellaneous charges as applicable, are not under the control and discretion of E-Visa Xperts and are subject to changes at any time as and when prescribed by Embassies/Government Authorities without issuing any prior notice to E-Visa Xperts. E-Visa Xperts hereby disclaims any liability concerning any changes imposed to the Visa Fees by any Embassy and/or Government Authority at any point in time. In case of any change in the rate of Visa Fees prescribed by any Embassy and/or Government Authority, the customers thereby will be liable to pay the revised rate of Visa Fees applicable on the date of submission of the Visa application at the Embassy and/or Government Authority, to proceed with the processing of the Visa application.
In a circumstance wherein the customer has paid the Visa Fees in advance to E-Visa Xperts, and post such payment if the Visa Fee charges are revised by the Embassy and/or Government Authority, then E-Visa Xperts will be entitled to recover the differential amount from the customer as per the new rate of Visa Fees applicable on the date of submission of the Visa application at the Embassy and/or Government Authority.

CANCELLATION FEES

The customer agrees that once a Booking ID for a visa application is generated, the consulate fee and Service Fee of E-Visa Xperts shall be non-refundable. However, the visa fee may be refundable only till such time the application is filed. Once the application has been submitted to the concerned Embassy/High Commission, the visa fee will be non-refundable. The aforesaid is as per the guidelines of the Embassy/High Commission and E-Visa Xperts has no control or authority over it.

LIMITATION OF LIABILITY:

E-Visa Xperts solely acts as a facilitator for Visa processing and is not responsible for the grant or rejection of visas in any manner whatsoever. Issuance of VISA is the sole decision of the concerned Embassy/ High Commission and E-Visa Xperts is not liable for the same. E-Visa Xperts shall not be liable for any incidental cost/expenses incurred by the Customer according to any denial or delay of visa application for any reason whatsoever.

Once E-Visa Xperts returns a passport and documents, it is the responsibility of the customer to check that all requisite VISAs have been obtained and details mentioned therein are correct and match the travel itinerary. In case of any error on the visa, kindly write to us at info@evisaxperts.com within 12 hours of the receipt of the visa approval. Our customer service representative will contact you. E-Visa Xperts shall not be held responsible for (including but not limited) to financial loss if the issue isn’t highlighted within 12 hours of the receipt of the visa approval.

The customer shall also check his/her details mentioned on the VISA issued. The customer shall also understand that even when a VISA is issued, he/she may be denied entry as it is the local immigration authorities who have a final say on entry decisions and in that case, E-Visa Xperts cannot be held liable.

E-Visa Xperts also recommends that the Customer secure a VISA before the date of departure. E-Visa Xperts will not be liable in any respect or for any loss or delay caused by events including but not limited to acts of God, weather conditions, acts of public enemies, war, strikes, civil commotions, or acts or omissions of public authorities (including passport and embassy consular officials). The customer also agrees that in case of rejection, if the Customer wishes to reapply/appeal against rejection of the Visa, E-Visa Xperts shall do the same strictly under the instructions of the Customer. The reapplying/appeal shall be a fresh transaction and the Customer will be liable to pay the applicable fee for such reapplying/appeal process along with the service fee to E-Visa Xperts. Unless instructed by the Customer, E-Visa Xperts will not initiate reapplication of any Visa application.

For visa applications where submission of passports is required, E-Visa Xperts shall take all necessary steps to ensure that the passport is safely delivered to the customer. However, the Customer agrees and undertakes that E-Visa Xperts shall in no way be held liable if the passport is lost in transit or misplaced.

COUNTRIES FOR WHICH THE SERVICES ARE BEING OFFERED

The countries for which the visa application services are being offered are mentioned in the visa section of the desktop site. The list of countries is subject to change at the discretion of E-Visa Xperts.

MODIFICATION OF TERMS AND CONDITIONS:

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

Variation of Terms

E-Visa Xperts is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

Entire Agreement

These Terms and Conditions constitute the entire agreement between E-Visa Xperts and you in relation to your use of this Website and supersede all prior agreements and understandings.

Governing Law & Jurisdiction

E-Visa Xperts hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction or country other than those where it is operating its offices. E-Visa Xperts considers itself and intends to be subject to the jurisdiction only of the courts of Bangalore, India.
